These Terms govern the use of the tamatebaco online store (the “Store”) operated by Tosho Seiko Co., Ltd. (“we”). By using the Store, you are deemed to have agreed to these Terms.
These Terms apply to all relations between you and us regarding use of the Store.
Your order is an offer to purchase. The sales contract is formed when we send you a shipment confirmation by email. As our products include limited, one-of-a-kind items, even after you place an order we may be unable to accept it depending on stock and production.
Prices are as shown on the Store, settled in US dollars (USD) or another displayed currency. Customs duties and import taxes for international delivery are prepaid by us (DDP).
Shipping is governed by our Shipping Policy; returns and refunds by our Refund Policy and Legal Notice. Given the made-to-order, one-of-a-kind nature, we cannot accept returns for a change of mind.
Copyright and other rights in the text, images, logos and designs on the Store, and in the serial numbers and certificates attached to products, belong to us or the rightful holders. Unauthorized reproduction or reuse is prohibited.
You must not engage in acts that violate laws or public order, infringe the rights of us or third parties, interfere with the operation of the Store, purchase for the purpose of resale, or that we otherwise deem inappropriate.
You represent and warrant that you are not a member of organized crime or other anti-social forces.
We strive for accuracy in the content and products of the Store but do not warrant their completeness or accuracy. For damages due to causes attributable to us, except in cases of our intent or gross negligence, our liability is limited to ordinary damages and to the amount you paid for the relevant product. However, where you are a consumer under the Consumer Contract Act, this clause does not apply to the extent it conflicts with that Act or other mandatory law.
These Terms are governed by Japanese law. The Tokyo District Court shall be the court of exclusive agreed jurisdiction for the first instance of any dispute between us and you regarding the Store or these Terms. This does not apply, however, where mandatory consumer-protection provisions of the law of your habitual residence apply to you.
We may change these Terms as needed. The revised Terms take effect when posted on the Store.
